Terms of Use
Acceptance
RetroRecord is a product of Maple Linens Inc. By creating an account or using RetroRecord, you agree to these Terms of Use. If you do not agree, please do not use the app.
Accounts & approval
New accounts must be approved by an administrator before you can sign in. Approval can be refused or withdrawn at any time. Keep your password confidential. You are responsible for activity on your account. You can delete your account at any time in Profile › Delete Account.
Music & content
RetroRecord is a player and a songbook. It does not supply, sell, stream or share music, and it does not download music from any other service. Every recording in it was added by a member from a copy they already had. All recordings, lyrics, trademarks, artwork and song titles belong to their respective owners, and nothing here transfers any right in them to you or to us.
Recordings you upload are for your personal use only
A recording you upload is a private copy for your own listening on your own account. It plays only for you. RetroRecord never streams it to other members, never makes it public and never sells it, and no other member can play it or download it.
You may upload a recording only if you own a lawfully obtained copy of it — for example a track you bought or a recording you made yourself — and only for your own personal, non-commercial listening. You may not upload a recording to share it with anyone, to make it public, to play it in public, or for any commercial purpose.
The administrator can access uploaded audio to moderate the service and to deal with a rights holder's complaint, and may remove any recording at any time.
What you promise when you upload
By adding a recording, lyrics, a photo or song details, you confirm that you own it or have the rights and permissions you need to use it this way, that your copy was obtained lawfully, and that using it in RetroRecord breaks no law and no one else's rights. You remain responsible for what you add. You agree to cover our reasonable losses if a claim is made against us because of content you added.
Copyright complaints and takedown
We respect copyright. If you own rights in a work and believe something in RetroRecord infringes them, write to [email protected] with: the work concerned, where it appears in RetroRecord, your contact details, and a statement that you believe in good faith that the use is not authorised and that the information you give is accurate. We will look into it promptly, remove or disable what is complained of where the complaint is justified, and tell the member who added it. Accounts of members who infringe repeatedly are closed.
Content you add
You can add songs, audio, lyrics and photos. Only add content you have the right to use. Audio you upload plays only for you; song details, lyrics and record photos you add are visible to other signed-in members, and by adding them you allow us to show them in RetroRecord for that purpose. You can edit or delete what you added at any time, and the administrator may edit or remove any content.
Licensing RetroRecord under your own brand
This section is for an organisation that licenses RetroRecord to offer it to its own members under its own name. It adds to the section above; everything there about ownership still applies.
How it is bought. By a written licence agreement with Maple Linens Inc. It is a subscription for a set term: you pay for the right to use the hosted software for that term, and the fees, the term, renewal and notice are set out in that agreement. You are not buying the software, a copy of it, or any part of it. Creating an account on RetroRecord is not a licence and gives no white-label rights.
What the licence covers. For the term, you may offer RetroRecord to your own members under your own name, logo and colours, at your own web address pointed at our servers. We host and run the software for you. You get the finished service — never the source code, a build, or access to our servers.
Your branding. Your administrators set your logo, your colours, the name your members see and your support links from your own dashboard. Doing that is configuration, not maintenance: it is yours to change whenever you like, and you never need our permission.
Your own database, where your agreement includes it. You may keep your members' content in a database on your own infrastructure. You give us the connection details once through the secure setup step; we test the connection, store the details encrypted, and from then on the software reads and writes your members' content in your database.
What that means for your data. The data stays yours, on your server, under your control, and you can take a copy at any moment without asking us. It also means you are responsible for that database: for keeping it running and reachable, for its backups, for its security, and for meeting the laws that apply to the data you keep in it. RetroRecord acts only as the software that processes it, over the connection you gave us. We are not liable for your database being slow, unreachable, misconfigured, full, or lost, nor for anything that follows from it, and the service will not work for your members while your database cannot be reached. We connect to it only as far as running the features you have switched on requires.
Updates. We improve, fix and secure the software centrally and roll that out to everyone. You never have to install or update anything, and we may change or withdraw features as described above. Only Maple Linens Inc., or someone we have authorised in writing, may host, update, change, maintain or support the software — this applies to your own developers and to any other supplier.
When it ends. The licence ends when the agreement ends or if it is terminated under it. After that you must stop offering RetroRecord under your brand and stop using the service. Your data is unaffected: it is on your own database, and anything of yours that sits on our servers is handed over or deleted as the agreement says.
If anything in your signed agreement expressly says something different from this section, your agreement governs.
No objectionable content
There is zero tolerance for objectionable content or abusive members. Don't add anything offensive, hateful, sexually explicit, harassing, infringing or unlawful. Use Report Song on any record to flag a problem, or Hide Songs from This Member to stop seeing a member's songs. Reports are reviewed within 24 hours; content that breaks these terms is removed and the member who added it may be removed from RetroRecord.
Ownership of the software, licence and maintenance
Who owns RetroRecord. The software is owned by Maple Linens Inc. (which runs its software practice as MapleFintech) and its licensors: the iPhone app, the server, the database design, the interfaces, the designs, the written material, and the RetroRecord name and logo. It is protected by the Copyright Act (R.S.C. 1985, c. C-42) and by other laws. Open-source parts we use keep their own licences. Every right we do not give you here stays with us.
What you get. A limited, non-exclusive, non-transferable right to use RetroRecord as we offer it, for as long as your account or licence lasts, with no right to sublicense it. If an organisation is licensed to offer RetroRecord to its own members under its own name and branding, that licence is for that organisation's own business. RetroRecord is licensed, not sold: using it, or putting your own name on it, does not transfer ownership of any part of the software.
No source code. We do not hand over source code. The iPhone app is a finished program, and the service runs on our own servers. The web pages necessarily send your browser the code it needs to display them; that code is still ours and is covered by this section.
What you may not do. Don't copy, change, translate or build something derived from the software; don't decompile or reverse engineer it, except to the extent the law expressly allows despite this restriction; don't remove or hide ownership notices; don't resell, rent out, host or sublicense it; and don't use it to build a competing product.
Who may work on it. Only Maple Linens Inc., or someone we have authorised in writing, may host, update, change, maintain or support RetroRecord. A licensed organisation may not give that work to its own developers or to another company, or give anyone access for that purpose. Changing the settings the product gives you — your branding, your members, your songs, lyrics and record photos — is configuration, not maintenance, and is yours to do whenever you like.
Your own content stays yours. Nothing here changes who owns the songs, lyrics, photos and recordings you add, or your right to a copy of them; see "Content you add" and the Privacy Policy. If you send us an idea or a suggestion, we may use it freely without owing you anything.
If this is broken. We may suspend or end an account or a licence, and because money alone may not undo the harm of software being copied or passed on, we may also ask a court to stop it. This section, and your promises about content, continue to apply after your account ends.
A separate signed agreement. If an organisation has signed its own licence agreement with Maple Linens Inc., this section still applies except where that agreement expressly says otherwise.
Acceptable use
Don't try to access other members' accounts, get around the approval process, reverse-engineer the app's security features, or use RetroRecord for any unlawful purpose. Don't use RetroRecord to copy, distribute or publicly perform music you have no right to, and don't try to download or extract another member's recordings.
The assistant
The assistant gives automated suggestions and controls playback when you ask it to. Its answers may not always be accurate.
Availability & changes
We may update, suspend or discontinue features at any time. We may revise these terms, and continued use after a change means you accept the updated terms.
Disclaimer
RetroRecord is provided "as is" without warranties of any kind. To the fullest extent permitted by law, we are not liable for indirect or consequential losses arising from use of the app.
